False Rape Case: Woman Sentenced to 1653 days in Jail

In a historic Judgement a woman in Bareilly has been charged by the Additional District Court under Section 195 for providing false and fabricated evidence with the intent to secure a conviction. This action comes in response to her alteration of testimony and turning hostile in a case involving confinement and rape.

On Saturday evening, Additional District Judge Gyanendra Tripathi handed down a sentence of 1653 days in jail to the woman, coupled with a cash fine of Rs 5.9 lakh. The court emphasized the repercussions of the survivor/accused’s false statement, highlighting that an innocent man endured 1653 days (equivalent to 4 years, 6 months, and 8 days) behind bars. It underscored the commitment of both the government and the judiciary to address complaints related to women, yet emphasized that this shouldn’t pave the way for women seeking to exploit the law unfairly, thereby infringing upon the rights of men.

In the year 2019 Ajay Kr was allegedly booked for kidnapping and raping his colleague’s sister. The girl, then 15 year old, had told police and the court that she had been kidnapped and raped by Ajay. 

It is learnt that Ajay was booked under sections of wrongful confinement, rape under Posco Act on the complaint of the girl’s mother. The girl told the court that she had been sedated, confined, and raped by Ajay. After four years, she changed her statement and told the court that Ajay was innocent. The session court then booked her under section 195 of the IPC. The court also noted that the victim had changed her statement in favour of the accused allegedly due to financial incentives.
